Green Cards

Green Cards

A Permanent Resident Card, which is popularly called a Green Card, is what enables an immigrant to live and work on a permanent basis in the U.S. Not everyone takes the same steps to get there. In many ways, it is their unique set of circumstances that will determine the process for them. It is because this process can be so complicated that immigrants are advised to work with a qualified attorney. A Miami immigration attorney like the practitioners at Almeyda Law, P.A. will help you figure out whether or not you are eligible for a Green Card and the steps you must take to achieve your goal.

Initially, two forms are required to begin the process of obtaining a Permanent Resident Card. These are an immigrant petition and an application for a Green Card. In virtually every case, someone else will be required to file the petition on behalf of the immigrant. This individual typically is already a U.S. citizen. They can petition on behalf of a relative, a refugee or an employee. Other types of petitions also may be available. In limited circumstances, the applicant may be able to petition on their own behalf. If you want to know whether or not this option applies to you, you’ll want to speak to a qualified immigration lawyer in Miami.

The U.S. Customs and Immigration Service then reviews the petition. If it is approved, then the immigrant must file an application. A biometrics appointment where the immigrant’s fingerprints, photo and signature are collected is scheduled next. A subsequent interview is a mandatory part of the process. Once the interview is complete, the applicant awaits the decision of U.S. Customs and Immigration Service.

Initial approval for a Green Card grants permanent resident status for two years. If this period is passed successfully, then the immigrant may receive a permanent residence visa that is valid for 10 years. This Green Card can be renewed an indefinite number of times as long as you do not commit any crimes or violate your immigration status.

The U.S. government issues only a predetermined number of Green Cards each year. Accordingly, this is a highly competitive and complicated process. If you want to better ensure your chances of success, then it makes sense to work with a Florida immigration attorney who has already assisted dozens of immigrants obtain their Green Cards.

Doing so ensures that your paperwork is filled out correctly and that all of the qualifications are met. Filing correct documents in a timely fashion will help get your application through the process with fewer delays.
