To qualify for asylum, you must demonstrate that you have suffered persecution or have a well-founded fear of future persecution based on one of five protected grounds: race, religion, nationality, membership in a particular social group, or political opinion. The persecution must be carried out by your government or by a group your government is unable or unwilling to control. Each case is evaluated individually based on the specific facts and country conditions.
U.S. law requires you to file your asylum application (Form I-589) within one year of your last arrival in the United States. Missing this deadline can make you ineligible for asylum, though limited exceptions exist for changed circumstances or extraordinary circumstances that prevented timely filing. Because of how critical this deadline is, you should consult with an attorney as soon as possible after arriving in the U.S.
You can apply for an Employment Authorization Document (EAD) 150 days after filing your complete asylum application, and USCIS must process it within 30 days after that. However, processing times can vary. If your application is incomplete or referred to immigration court, the timeline may differ. A credible fear interview is conducted by a USCIS asylum officer, usually within days of being apprehended at or near the border. You must demonstrate a significant possibility that you could establish eligibility for asylum. If USCIS denies your affirmative asylum application, your case is typically referred to immigration court where you can present your claim before an immigration judge. You may also be eligible for withholding of removal or protection under the Convention Against Torture (CAT), which have different legal standards.
