An uncontested divorce in Florida can be finalized in as little as 4–6 weeks if both parties agree on all terms. A contested divorce—where there are disputes over property, custody, or support—can take 6 months to over a year depending on the complexity. Florida has a mandatory 20-day waiting period after filing before a divorce can be finalized. We work to resolve your case as efficiently as possible while making sure your rights are fully protected.
Florida does not use the term “custody.” Instead, the court establishes a parenting plan that includes time-sharing and parental responsibility. The court decides based on the best interests of the child, considering factors such as each parent’s ability to meet the child’s needs, the stability of the home environment, the child’s preference (if mature enough), and the willingness of each parent to encourage a relationship with the other. There is no automatic preference for either mother or father.
Florida uses a statutory formula based on both parents’ net incomes, the number of children, and the amount of overnight time-sharing each parent has. The court may also consider childcare costs, health insurance premiums, and extraordinary expenses. The resulting amount can be adjusted up or down by up to 5% at the court’s discretion, and deviation beyond 5% requires specific written findings.
